Introduction
This website is owned and operated by Jenny Wickman. Any references to “me", "my", or “mine”, relate to Jenny Wickman, and references to “you,” “your,” and “yours” refer to the clients, and website visitors. These Terms of Service govern your access to and use of my website, contents, functionality, mobile applications, downloadable products, such as templates and/or any other products, and/or web design services. By using my website, you agree to comply with and be bound by these terms. If you do not agree with these terms, do not use my website.
Eligibility - Use of My Website
By using my website, you certify that you are at least 18 years old and have the right to use the website, or have parental consent to form a binding agreement. If you are under 18, do not use my website without prior parental consent and approval. My website is not intended for children under 18. If you are under 18, you should not create an account, use the website, post comments, or provide any personal information. If I discover that you are under 18, and you do not have parental consent, your information will be deleted.
Account Registration
When you create an account on my website, you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account.
Product Information and Orders
​Accuracy of Information
I strive to provide accurate descriptions and images of my products and/or templates, demo sites and other sites. However, I do not guarantee that product descriptions, images, or other content on my website are accurate, complete, reliable, current, or error-free.
Order Acceptance
I reserve the right to refuse any order or web design project, for any reason, including but not limited to errors in product pricing information, or suspected fraud.
Payment & Past Due Fees
Payment must be made by the customer before an order can be processed. I accept common credit cards and other payment methods listed on my site, like Pay Pal. You agree that any credit card, or PayPal account used to pay for your order, and billing address, that you have the right to use that card, payment method and address. If payments are delinquent, you agree to pay any late fees and interest on past due balances.
Returns and Refunds
No refunds will be provided for template purchases, once the files have been downloaded. If there are any issues with the website template you purchased, you agree to let me know about it, so that i can correct it for you.
For Web Design refunds before a project is complete, the first half of the payment is non-refundable. Refer back to the contract you signed when agreeing to design work, for specific information on refunds that concern you.
Once the website is complete and it has been transferred to your Wix account, no refunds are given.
Licenses
Websites or Templates that you purchase are meant for you and only you, and cannot be transferred to any of your clients without a license to do so. If you want a license to use it for a client on a one-time, one-client basis, contact me. Each time you want to use the template for a new client, you will need to purchase a license for each new client and each new website.
Intellectual Property
Ownership
All content on my website, including text, graphics, logos, images, designs, video and audio, and software, is the property of either Jenny Wickman or Wix (free graphics), or the content providers/designers and is protected by applicable intellectual property laws. You may not download any of the content on this website to your computer, upload it to servers, share on social media unless otherwise stated and agreed upon. You may not copy my designs, trademark them as if they are yours, lie and say i copied your designs and then sue me for trademark violation.
Reproduction
You may not reproduce, distribute, modify, or resell any material found on this website. You may not copy my websites or templates or sell them to clients as your own. You may not claim that you have made my templates yourself. You may however, purchase my templates, and re-design them for your clients, with a special license that you purchase from me.
Liability and Release
To the extent permitted by law, you agree to defend, and hold Jenny Wickman, not liable for any indirect, incidental, special, or consequential damages arising from or in connection with your use of this website, or any other website that I have designed for you, any web design projects, or any other design work, any templates, or content. You agree to hold me not responsible for any attorney fees, or legal expenses that may incur through your use of the website, it's content, or it's products, other than what has been authorized in these terms of use. You agree that Jenny Wickman will not be held responsible for any loss of contracts, loss of income, loss of reputation or any other losses that may occur.
Technology and Hacking
In the event of a hacker attack to either my website or your website and any losses you may face, you agree to hold Jenny Wickman, not responsible.
Governing Law
These Terms of Service are governed by and construed in accordance with EU law.
Termination
I have the right to terminate your access to my website at any time, block you from contacting me if you harass me any reason, spam me, if you send me any sort of deceptive links, or false information, or if I suspect that you are a fake Wix partner. However, I will not block or terminate your access, if we have a contract and i am working on your design project.
Changes to Terms
I reserve the right to update or modify these terms at any time without prior notice. I will not notify you of any updates. You are encouraged to check back regularly for updated information. Your continued use of my website after any changes constitutes your acceptance of the revised terms.
